Real Estate is an Essential Business

March 27 – Broward County enacted a new more restrictive Emergency Order (Emergency Order 20-03) that went into effect on March 27th. Although the emergency order creates new restrictions for residences & businesses, there is now clarification on how the Order specifically applies to real estate.

After extensive efforts by our Government Affairs Team for clarification of the prior Order, Real Estate has now been deemed to be an “Essential Business” as long as services are provided electronically or remotely.
Section 3 of the new Order states: “Essential Businesses…may remain open, but shall practice and ensure persons interacting with and within such businesses practice social distancing and all other measures as advised by the CDC”.

Section 3.oo of the new Order goes on to state: “Real estate sales and real property title services, provided such services are performed only electronically or remotely as permitted in Section 4.”

Section 4 of the new Order states: “…commercial businesses may perform remote work so that a business’s employees may interact with each other and/or with customers solely through electronic or telephonic means, and deliver services or products via only electronic means or mailing, shipping or delivery of services.”

Section 5 of the Order goes on to state: “This order does not limit the number of persons who may be physically present and performing services on-site related to the operations of an Essential Business…”

Florida Open House CDC Guidelines

Here are the new Florida open house CDC Guidelines:

Open Houses MUST Adhere To CDC Guidelines

The Florida Surgeon General has informed Florida Realtors of anecdotal reports of open houses with more than 10 attendees. It is essential that any open house adhere to CDC recommendations for safe social distancing.

Housing is an essential need and Realtors in Florida need to continue to work to provide it, but only in a safe format. Please note that yesterday, Florida Realtors, the Florida Land Title Association and the Florida Home Builders Association asked Gov. Ron DeSantis to consider real estate transactions and title recording essential services which should remain active, pledging to adopt steps to minimize health and safety risks for practitioners and customers.

Please ensure your social media and advertising communications do not mislead the public about access to open houses in large groups. Please institute controls to ensure no more than 10 people, including yourself, gather at one time, and keep to the required 6-feet distance between individuals.

P.S. I heard this morning that non-bank lenders may have issues with funding of new loans because of the current changes in the capital and credit markets. If you are working on an upcoming closing that required financing you may want to follow up with your customer or the other agent if you represent the seller. If the buyer is using a “mortgage company” instead of a direct lender like a bank this may cause a delay in closing.

Intercoastal welcomes BCPA representative Marty Kiar

Intercoastal Realty was happy to have Marty Kiar, Broward County Property Appraiser, speak at our office meeting.  Mr. Kiar provided a wealth of knowledge valuable to our professional realtors and our customers.  Important information on the portability of property homesteads, property valuation and the appeal process were detailed.  Mr. Kiar also provided his direct phone and email information for our realtors to contact him with any questions they or their customers might have.  This access and information will be used to educate our buyers and sellers on the benefits and cost savings of homestead and other potential tax saving exemptions.

Mr. Kiar continues the tradition of speakers coming into Intercoastal Realty’s office to help educate our realtors, staff and customers.

Other recent speakers have included:

Florida State Representative George Moraitis.  Representative Moritias discussed current and proposed legislation initiatives impacting real estate and Fort Lauderdale.

Fort Lauderdale Fire Marshall and Deputy Fire Chief Jeffrey Lucas. Chief Lucas discussed the current fire safety regulations for homes, apartments and condominiums.  The recent fires in apartment towers in London and Hawaii provided new focus on how Fort Lauderdale’s Fire Department is working with building owners and managers to insure the safety of Fort Lauderdale residents.  The rules and regulations are complex and have sometimes been misunderstood.  Chief Lucas provided clarity on these issues allowing Intercoastal Realty’s realtors to provide current and comprehensive information to our customers.
